n today’s society there seems to be an epidemic, an epidemic of grandparents raising grandchildren. With girls becoming pregnant younger and younger, the only responsible parties involved are the grandparents of the child. Therefore, they become the one’s responsible for this new life. There are also other reasons for a grandparent to become a parent of a child, including military cases where a parent is deployed or other similar situations due to unforeseen circumstances. “The Grandparents Rights Custody Center” offers much needed information on grandparents rights. No matter what these can be difficult and trying situations for all involved.

Not only is this a difficult experience for the new grandparents emotionally and financially in most cases, it can also become a difficult experience legally. There are legal issues involved for grandparents who are raising their grandchildren, depending on the expectations of the child’s parent. While some young mothers and fathers are happy to hand over their rights to the child, others may feel entitled to keep the rights to the child, minus the responsibility of raising them. Though this is a sad case, these cases are out there.

To keep from becoming a victim of this type situation you as a grandparent must know from the beginning your rights and must talk with the child’s parents about their expectations and their wishes to establish an agreement from the very beginning. Never allow assumptions to be made that will become issues in the future legally for you and your grandchild’s parents. This can be trying on you, but even more so on the child as they grow up and begin to understand the situation at hand.

Some of the issues which can arise that you must be aware of include:

- Power of Attorney – A parent can choose to give power of attorney rights of their child to a grandparent in order to allow that grandparent to make decisions legally for the child. This will allow them to make decisions regarding the child’s schooling, medical issues, and other common issues. This power of attorney however is not permanent and can be revoked by the person who gave the power in the first place.

- Medical consent. – In some states medical consent can be signed over from a parent to a grandparent of a child to allow them to make medical decisions regarding that child. This involves signing simple paperwork.

- Legal child custody, guardianship or adoption. – If it comes to it, many times grandparents will seek custody, guardianship or adoption of their grandchildren. This is one particular area where it is important that you know and understand your legal rights. Each of these potential possibilities is different and therefore it is important that you seek legal help and that you do your research.Grandparents raising grandchildren are in increasing numbers and more legal rights are being addressed everyday.
